Welcome to Mobius. These Terms of Use ("Terms") are a binding agreement between you and [Legal entity name] ("Mobius", "we", "us", or "our") and govern your access to and use of the Mobius website, applications, and related services (together, the "Service"). Please read them carefully.

1. Acceptance of these Terms

By creating an account, clicking "I agree", or accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Changes to the Terms or the Service

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide notice in the Service or by email. Changes take effect when posted; your continued use after that means you accept them. We may also modify, suspend, or discontinue any part of the Service at any time, and we are not liable to you for doing so.

3. Eligibility

You must be at least 16 years old, or the age of majority where you live, to use the Service. If you are under the age of majority, you may use the Service only with the involvement and consent of a parent or guardian who agrees to be responsible for your use. By using the Service, you represent that you meet these requirements.

You access the Service by signing in through a third-party provider (Google). You agree to provide accurate information, keep it current, keep your login secure, and accept responsibility for all activity under your account. Do not share your account or use anyone else's. Tell us promptly at hello@mobiusmcat.com if you suspect unauthorized access.

Mobius is built to help you learn, not to help you cheat. You agree to use the Service consistent with the academic-integrity and testing rules that apply to you, including the policies of your school and the official rules of any examination. You agree not to use the Service to gain or attempt to gain an unfair advantage on, or unauthorized access to, any live or proctored exam, and not to submit Mobius output as your own original work where that is prohibited. Practice questions Mobius generates are study material, not actual or leaked exam content. We may suspend or terminate accounts used in violation of this section.

7. Acceptable use

You agree not to: violate any law or regulation; upload or share content that is unlawful, infringing, harmful, harassing, or that violates others' privacy or publicity rights; access or interfere with systems, accounts, networks, or data you are not authorized to access; circumvent plan limits, security, or rate limits; use bots, scrapers, or other automated means except as we permit; reverse engineer or attempt to extract source code except where allowed by law; or distribute malware or spam. We may investigate and take appropriate action, including removing content and terminating accounts.

8. Your content and the license you grant us

The Service may let you submit content such as questions, notes, text, or images ("User Content"). You keep ownership of your User Content. You also represent that:

You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, and display your User Content solely to operate, secure, and improve the Service (for example, to classify a question you missed, generate practice that targets your gaps, and evaluate question quality). This license ends when you delete your User Content, except for limited retention needed for legal, security, fraud-prevention, or backup purposes. To run the Service, your User Content may be processed and temporarily stored, including in caches, logs, or backups; please do not submit sensitive personal information. If you send us suggestions or feedback, you grant us the right to use them without restriction or compensation. We may review, remove, disable, or restrict User Content at any time if we believe it violates these Terms or the law.

9. Copyright complaints

We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, email hello@mobiusmcat.com a notice that includes: identification of the copyrighted work; identification of the allegedly infringing material and its location on the Service; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act. We may remove or disable the material and, in appropriate cases, terminate repeat infringers.

10. Our intellectual property

The Service, including its software, design, text, graphics, features, and the questions generated for the shared bank (excluding User Content), is owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-transferable, revocable license to use it for your own MCAT preparation. You may not copy, modify, distribute, sell, lease, scrape, bulk-export, reverse engineer, or create derivative works from the Service or our content, use it to train a machine-learning model, or use it to build a competing product, except where such restriction is prohibited by law or we give written permission. "Mobius", our logo, and related marks are our trademarks; you may not use them without permission.

11. AI-generated content; educational disclaimer

Mobius uses third-party artificial-intelligence models to generate questions, explanations, and tutoring conversations. AI output may be inaccurate, incomplete, or out of date, and you should verify high-stakes information against official sources. The Service is for educational purposes only and is not medical, legal, financial, or other professional advice. Mobius is independent and is not affiliated with, endorsed by, or sponsored by the Association of American Medical Colleges (AAMC); MCAT is a registered trademark of the AAMC. We make no guarantee of any score, result, admission outcome, or improvement; your results depend on many factors beyond our control.

12. Third-party services

The Service relies on and links to third-party services (including Google for sign-in, Stripe for payments, Cloudflare for hosting and AI inference, and Anthropic and OpenAI for AI generation). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. We do not endorse, and are not liable for, third-party websites or content you reach through the Service.

13. Disclaimers; limitation of liability; indemnification

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBIUS AND ITS OPERATORS, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE APPLY TO THE EXTENT PERMITTED BY LAW.

You agree to indemnify and hold harmless Mobius and its operators, affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

14. Governing law and disputes

If you have a dispute with us, please email us first at hello@mobiusmcat.com so we can try to resolve it directly. These Terms are governed by the laws of [State / Country], without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in [Jurisdiction] for any dispute not resolved informally.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use creates risk or legal exposure for us or others. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
